Biography of Samuel Tekie

Samuel Tekie joined the Intellectual Property Group at Heenan Blaikie LLP in 2008 after more than 16 years of practice at a leading intellectual property law firm.

Mr. Tekie focuses on pharmaceutical and chemical patent infringement actions and Patented Medicines (Notice of Compliance) Regulations proceedings in Canada as well as Paragraph IV certifications in the United States. For these proceedings Mr. Tekie not only meets with suitable experts to prepare the evidence but also assists to prepare the submissions made in the proceedings. Mr. Tekie's activities have led to precedent setting decisions. His findings have been instrumental in several patents being deemed invalid by the Federal Court of Canada and foreign courts.

Mr. Tekie has years of experience advising clients on intellectual property protection of pharmaceutical and chemical subject matters, including preparation and prosecution of utility patent applications and preparation of infringement and validity opinions.

Mr. Tekie is a registered patent agent in Canada and the United States and is a licensed professional engineer in the Province of Ontario.

Biography of Marcelo K. Sarkis

Mr. Sarkis joined the Intellectual Property Group in 2008 after practising for more than 19 years in intellectual property law at a leading boutique firm.

Marcelo’s practice focuses primarily on assessing the validity and infringement of patents in Canada, the United States and Europe. He has participated in infringement and validity actions as well as in proceedings under the Patented Medicines (Notice of Compliance) Regulations in Canada, and Paragraph IV filings and related proceedings in the United States. His work has led to several leading pharmaceutical patents being deemed invalid and/or not infringed before the Federal Court of Canada.

Additionally, Marcelo’s work has resulted in the successful early launch of pharmaceuticals in the United States and Canada, as well as the termination and settlement of legal proceedings. He has extensive experience in the drafting and prosecution of patent applications in pharmaceutical, chemical and mechanical areas and has advised clients on the procurement, management and value assessment of intellectual property rights in various jurisdictions.

Marcelo is a Fellow of the Intellectual Property Institute of Canada and a registered professional engineer in Ontario.
